This website is operated by Wild Ivory LLC. Throughout the site, the terms “we”, “us”, and “our” refer to Wild Ivory LLC. Wild Ivory LLC offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something (a product or ticket/s) from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

Please read these Terms carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms are considered an offer, acceptance is expressly limited to these Terms.

Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell our products and services to you.

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information) may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission by us. Headings are for convenience only.

We are not responsible if information on this site is not accurate, complete, or current. Material is provided for general information only and should not be relied upon as the sole basis for decisions. Historical information is provided for reference only. We may modify site contents at any time with no obligation to update.

Prices are subject to change without notice. We may modify or discontinue the Service (or any part or content) at any time without notice. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance.

SECTION 5 – PRODUCTS, EXPERIENCES & SERVICES

Certain products or services may be available exclusively online and may have limited quantities. Returns or exchanges are governed by our Returns Policy. We aim to describe offerings accurately but do not guarantee device-display accuracy. We reserve the right to limit sales of products or Experience tickets, limit quantities, change descriptions or pricing, and discontinue any product/Experience at any time. We do not warrant that the quality of any products, services, information, or other material will meet your expectations, or that any errors in the Service will be corrected.

SECTION 6 – ACCURACY OF BILLING & ACCOUNT INFORMATION

We may refuse any order and limit or cancel quantities per person, household, or order. If we change or cancel an order, we may attempt to notify you via the email and/or billing address/phone number provided. We send information about events to the email address provided at checkout. You agree to provide current, complete, and accurate purchase and account information and promptly update it as needed.

SECTION 6A – REFUNDS, TRANSFERS & NO-SHOWS (ADDED)

Unless otherwise stated on the event page: (a) all ticket sales are final; (b) tickets are transferable to another attendee by written request at least 24 hours before the Experience; (c) no-shows forfeit the ticket price; and (d) if we cancel or materially reschedule an Experience, you will receive either a refund or credit at our discretion.

SECTION 6B – GIFT CARDS & CREDITS

If offered, gift cards/credits are redeemable only for eligible purchases on our site, not reloadable, not redeemable for cash except where required by law, and subject to fraud prevention. Lost or stolen cards will not be replaced except as required by law.

SECTION 7 – OPTIONAL TOOLS

We may provide access to third-party tools “as is” and “as available” without warranties or endorsements and with no liability arising from your use. Your use is at your own risk and subject to the provider’s terms. Future new features/services are also subject to these Terms.

SECTION 8 – THIRD-PARTY LINKS

Third-party links may direct you to websites not affiliated with us. We are not responsible for examining or evaluating content or accuracy and assume no liability for third-party materials, products, services, or websites. Review third-party policies before transactions.

SECTION 9 – USER COMMENTS, FEEDBACK & OTHER SUBMISSIONS

If you send us comments (ideas, suggestions, proposals, plans, etc.), you agree that we may edit, copy, publish, distribute, translate, and otherwise use them in any medium, without obligation to maintain confidentiality, compensate you, or respond. We may monitor, edit, or remove content at our discretion. You are responsible for your comments and their accuracy and agree not to violate any third-party rights or laws.

Your submission of personal information through the store is governed by our Privacy Policy.

SECTION 11 – ERRORS, INACCURACIES & OMISSIONS

We may correct errors, inaccuracies, or omissions and change or update information or cancel orders if any information in the Service or on related websites is inaccurate at any time without prior notice (including after you have submitted your order). We undertake no obligation to update information except as required by law.

SECTION 12 – PROHIBITED USEs

In addition to other prohibitions in these Terms, you are prohibited from using the site or its content: (a) for unlawful purposes; (b) to solicit unlawful acts; (c) to violate regulations, rules, laws, or ordinances; (d) to infringe upon IP rights; (e) to harass, abuse, defame, or discriminate; (f) to submit false or misleading information; (g) to upload or transmit malware; (h) to collect/track others’ personal information; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for obscene or immoral purposes; (k) to interfere with security features; or (l) to use automated tools to scrape or harvest site content or metadata without our written permission. We may terminate use for violations.

SECTION 12A – NO MEDICAL ADVICE

Content shared at Experiences or on our site (including wellness topics) is for educational and informational purposes only and is not medical advice. Always consult a qualified healthcare professional regarding any questions about a medical condition, supplements, or treatments.

SECTION 12B – ALCOHOL / BYOB

Where permitted and only if expressly stated for an Experience, attendees who consume alcohol must be of legal drinking age and drink responsibly. You agree not to drive under the influence. We may refuse or revoke participation for safety concerns.

SECTION 12C – PHOTO & VIDEO RELEASE

By attending our Experiences, you consent to photography, audio, and video recording and to the release, publication, exhibition, or reproduction of such media for promotional purposes in print and digital channels, without compensation. If you prefer not to be recorded, please notify staff on arrival; we will make reasonable efforts to accommodate.

SECTION 12D – HEALTH & SAFETY

You agree to follow venue rules and staff directions, and you confirm you are fit to participate. Do not attend if you are ill or contagious. Allergens may be present; notify us in advance of any allergies—reasonable accommodations may be possible but are not guaranteed.

SECTION 12E – ASSUMPTION OF RISK & RELEASE

You understand that participation in Experiences may involve inherent risks (including but not limited to slips/falls, physical activity, exposure to allergens, use of tools or hot wax, and consumption of food/drink). To the fullest extent permitted by law, you voluntarily assume all such risks and release and hold harmless Wild Ivory LLC and its partners and venues from claims arising from participation, except to the extent caused by our gross negligence or willful misconduct.

SECTION 13 – DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free, or that results will be accurate or reliable. You agree we may remove the Service for indefinite periods or cancel it at any time without notice. The Service and all products/services are provided “as is” and “as available” without warranties of any kind, express or implied. In no case shall Wild Ivory LLC or its affiliates, partners, venues, or vendors be liable for any indirect, incidental, punitive, special, or consequential damages, or any loss of profits, revenue, savings, data, or replacement costs, arising from your use of the Service or any product/Experience, even if advised of the possibility. Some jurisdictions do not allow certain limitations; in such cases, liability is limited to the maximum extent permitted by law.

SECTION 14 – INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Wild Ivory LLC and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, employees, and venue partners from any claim or demand (including reasonable attorneys’ fees) made by any third party due to or arising out of your breach of these Terms or your violation of any law or third-party rights.

SECTION 15 – SEVERABILITY

If any provision of these Terms is unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed, without affecting the validity of remaining provisions.

SECTION 16 – TERMINATION

Obligations and liabilities incurred prior to termination survive termination. These Terms are effective unless and until terminated by either party. We may terminate if you fail or we suspect you have failed to comply with any term or provision, and we may deny access to the Service accordingly.

SECTION 17 – ENTIRE AGREEMENT

These Terms and any policies or operating rules posted by us on the site constitute the entire agreement and supersede any prior agreements, communications, and proposals, whether oral or written, between you and us. Ambiguities shall not be construed against the drafting party.

SECTION 18 – GOVERNING LAW & VENUE

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the United States and the state in which the relevant claim arises, without regard to conflict of law principles.

You agree that any disputes not subject to informal resolution shall be brought exclusively in the state or federal courts located in the United States in a venue appropriate to the location of the Experience, product purchase, or other transaction giving rise to the dispute.

If you access or use our Services from outside the United States, you do so at your own risk and are responsible for compliance with local laws.

SECTION 18A – DISPUTE RESOLUTION; CHARGEBACKS

Before initiating any formal action or chargeback, you agree to first contact us at hello@wildivory.com and provide a reasonable opportunity (not less than 15 days) to resolve the issue. Unfounded chargebacks may be treated as a breach of these Terms.

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to our website. Your continued use of the website or the Service following the posting of any changes constitutes acceptance of those changes.

  • Event Partners: select vendors or venues for Experiences you register for

5. Your Choices

You may opt out of marketing emails at any time using the unsubscribe link in Flodesk emails. You may also access, update, or request deletion of your personal information by contacting us. Declining cookies may limit some site features.

We retain your information as long as needed to provide Services, comply with legal obligations, or resolve disputes. We take reasonable measures to protect your information, though no system is completely secure.

By attending Wild Ivory Experiences, you may be photographed or recorded. We may use this media for promotional purposes unless you notify us before the event.
